General Terms and Conditions of Business for Morawetz


Our general terms and conditions are effective with every order of the customer. These can be viewed at any time on the Internet pages of the company Morawetz.

 

1. Order
The contract between the customer and MORAWETZ comes about through an order from the customer and its acceptance by MORAWETZ. The order signed by the buyer is binding, for orders through the Internet, the sending of the order is binding. MORAWETZ accepts the order by sending the customer an order confirmation (by fax, e-mail or letter mail) or - the ordered goods (including invoice or delivery note). The prices valid on the day of delivery are calculated on the Internet, unless other agreements have been made in writing. All prices are excl. Of VAT. If no prices are given, the shop mainly has a catalog function and the concrete prices are immediately delivered in the form of an offer.

2. Delivery
We deliver parcel service and mail. The shipping costs are indicated for online ordering. Stock will be delivered by us within 3 days. Other items have a delivery time, which is dependent on that of our pre-supplier. Accurate information is given by order.

3. Terms of payment
This agreement is governed by Austrian law. The court of jurisdiction is Austria / Vienna. Invoicing is in euros. The payment methods are listed in the onlineshop. We reserve the right to reject a payment method selected by the customer even after the order has been placed and insist on payment in advance. In this case, we shall contact the customer immediately.



4. Transfer of ownership
Delivery is subject to retention of title. MORAWETZ remains the owner of the delivered goods until the final payment of the purchase price.

5. Warranty
For all products offered on the Internet, the guaranteed functionality is 12 months. This period begins with the delivery. During the warranty period, the customer may require MORAWETZ to rectify or replace the defect. The customer is obliged to send the defective article, free of charge, together with the invoice and the delivery note to Fa MORAWETZ, Seeböckgasse 26, A1160 Vienna - Austria, upon agreement with MORAWETZ. If the value of the goods is less than Euro 40,00, the buyer will be charged back. If the defect can not be remedied by rectification or replacement delivery within a reasonable period, the buyer may, at his discretion, demand a reduction of the purchase price or a cancellation of the purchase contract. Claims of the Purchaser for warranty are dependent on the fact that the Purchaser shows obvious defects within two weeks and not obvious defects within six months after delivery. The warranty expires if changes or repairs are made to the goods without the written consent of MORAWETZ. The assignment of warranty claims to third parties is excluded.

6. Liability
The liability of MORAWETZ is independent of the legal basis to max. Shall be limited to 10 times the purchase price (excluding VAT) of the item which caused the damage or is the object of the claim or is directly related to it. The higher amount applies. MORAWETZ is not liable for loss of profit, lost savings or damages from claims of third parties.

7. Revocation instruction
Right of revocation You can revoke your declaration of the contract within two weeks without stating reasons in text form (eg letter, fax, e-mail) or by returning the goods. The period begins at the earliest upon receipt of this instruction. The timely dispatch of the revocation or of the goods is sufficient to ensure the revocation period. The revocation is to be addressed to our address stated on the order confirmation.

Revocation Sequence

In the case of an effective revocation, the services received at both ends must be returned and any benefits (eg interest) taken. If you are unable to return the received performance in full or in part or only in a deteriorated condition, you may have to provide us with a decree. [This does not apply to the transfer of goods if the deterioration of the goods is exclusively due to their examination - as it would have been possible for you in the store business, for example. In addition, you can avoid the obligation to make a purchase by not using the item as an owner and omit anything that could impair its value.

In the case of a return from a goods delivery whose total order value is up to 40 Euro, you have to bear the cost of the delivery (shipping costs) and the return if the delivered goods correspond to the ordered goods. Otherwise, the return is free for you."

Non-package items will be collected from you.

"Your right of revocation expires prematurely if your contract partner has begun to execute the service with your explicit consent before the end of the revocation period or if you have initiated it yourself (eg by downloading etc.)."

8. Privacy Policy
Customer data are not made available to third parties. Credit card data will be deleted after the completed transaction.

We inform our customers at irregular intervals by e-mail newsletter. Customers who do not wish to do so may inform us in the "Note to Us" field. Of course you can unsubscribe by e-mail at any time. All associated data is then deleted.
